By downloading, installing, or using BCBA Tracker ("the App"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Who May Use This App:

BCBA Tracker is intended for professional use by:

• Board Certified Behavior Analysts (BCBAs)
• Registered Behavior Technicians (RBTs)
• Special education teachers
• Therapists and clinical professionals
• Other qualified educational professionals working with students with behavioral needs

2. Description of Service

2.1 Purpose

BCBA Tracker is a professional behavioral data collection tool designed to help educators and therapists:

• Record behavioral observations in real-time
• Track student progress toward behavioral goals
• Generate professional reports for parents and administrators
• Analyze behavioral data through charts and visualizations
• Support evidence-based decision-making for behavioral interventions

2.2 Offline-First Design

BCBA Tracker operates offline-first:

• All data is stored locally on your iOS device
• No internet connection required for core functionality
• Optional manual backup to your personal Google Drive account
• No automatic cloud synchronization or remote data transmission

2.3 Data Collection Methods

The App supports Applied Behavior Analysis (ABA) standard methodologies:

• Frequency Recording (event counting)
• Duration Recording (time measurement)
• ABC Data (Antecedent-Behavior-Consequence)
• Interval Recording (partial/whole/momentary)
• Discrete Trial Training (DTT)
• Task Analysis with chaining

3. User Responsibilities

3.1 Professional Use Only

You agree to use BCBA Tracker:

Before collecting behavioral data for any student, you are responsible for:

• Obtaining necessary parental or guardian consent
• Informing parents about data collection practices
• Providing parents with our Privacy Policy
• Respecting parental requests for data access, correction, or deletion
• Complying with your school or organization's consent procedures

3.3 Data Security

You agree to:

• Secure Your Device: Use a strong passcode and enable Face ID/Touch ID
• Protect Your Google Account: If using backup, enable 2-factor authentication
• Not Share Your Device: Keep your iOS device in your personal possession
• Report Lost/Stolen Devices: Immediately notify your school/organization if device is lost or stolen
• Properly Dispose of Data: Use secure deletion when removing student records

4. Data Ownership and Use

4.2 School/Organization Policies

If you use BCBA Tracker as part of your employment:

• Your school or organization may own the data under employment agreements
• You must comply with your school/organization's data retention policies
• Consult your employer regarding data ownership and usage rights

7.2 Professional Judgment

BCBA Tracker is a data collection tool, not a replacement for professional judgment:

• You are responsible for interpreting behavioral data appropriately
• Clinical decisions must be made by qualified professionals
• The App does not provide diagnostic or treatment recommendations
• Consult with supervisors, BCBAs, or clinicians for complex cases

7.3 Limitation of Liability

To the maximum extent permitted by law, BCBA Tracker and its developers shall NOT be liable for:

• Data loss or corruption (back up your data regularly!)
• Unauthorized access to your device (secure your device!)
• Decisions made based on data collected in the App
• Violations of FERPA, COPPA, or other laws resulting from your use
• Indirect, incidental, special, consequential, or punitive damages
• Lost profits, revenue, or business opportunities

Maximum Liability: In no event shall our total liability exceed the amount you paid for the App (if any).

8. Data Backup and Loss

8.2 No Data Recovery Guarantee

We cannot recover data that you have deleted or lost:

• Deleted students and sessions are permanently removed
• Device loss/theft = data loss (unless you have backups)
• App deletion = data deletion (Core Data is removed)
• iOS updates or device failures may corrupt data

Back up your data regularly to prevent irreversible loss.
